BIOGRAPHY:
Thomas A. McDonald is an equity member of McDonald & McCabe,
LLC. Mr. McDonald is an active trial attorney. He currently represents
property insurers and tries complex property insurance coverage cases and
major property subrogation cases. He has represented self insureds and
insurers in several mass disaster cases in jurisdictions throughout the United States. Mr. McDonald
also has extensive experience representing clients in alternative dispute
resolution fora nationwide. He has tried a wide variety of liability
cases in state and federal courts throughout the United States
and has obtained property subrogation recoveries in foreign
jurisdictions.
Mr. McDonald’s property insurance experience includes
coverage analysis and litigation involving arson, fraud, contamination,
product recall, application of deductibles, flood, business interruption,
extra expense, exclusions under All Risk Coverage, sue and labor, boiler
& machinery, DIC, and other first party coverage issues. Notable
property insurance cases include the First Interstate Fire (Los Angeles, California),
Quantum Chemical Company (Morris,
Illinois), and Ford Motor
Company (Dearborn, Michigan).
Mr. McDonald’s subrogation recovery experience
includes a wide variety of cases, domestically and abroad, including the
Celanese Chemical Company plant explosion (Pampa, Texas), Quantum
Chemical Company explosion (Morris, Illinois), Arlington Park Race Track
fire (Arlington Heights, Illinois), Vital Industries Company fire
(Gainesville, Florida), Iron Street fire (Chicago, Illinois), Jefferson
Street fire (Chicago, Illinois), Central Manufacturing District fire
(Chicago, Illinois), Casa Margarita Ville collapse (Santa Cruz,
California), First Interstate fire (Los Angeles, California), Fleischer
residence fire (Scottsdale, AZ), Kaufman Machinery Company fire
(Waukegan, Illinois and Alesund, Norway).
Mr. McDonald has lectured at the Defense Research Institute,
Illinois Trial Lawyers Association, the Property Loss Research Bureau,
and the Western Loss Association. Mr. McDonald also has presented insurance
and adjusting company training seminars on a variety of issues including
alternative dispute resolution, spoliation of evidence, licensing and use
of experts, property subrogation, economic loss, arson, bad faith and
product liability coverages. He has authored papers for and lectured at
various continuing legal educational programs. He has also presented
papers at national insurance industry meetings and seminars. He is a
member of the Loss Executive Association.
