McDonald &
McCabe’s attorneys have extensive experience interpreting and litigating
insurance coverage matters. We provide our insurance company clients with
in-depth analysis and coverage opinions and defend and prosecute
declaratory judgment actions on behalf of our insurance company clients.
We have litigated and counseled our clients on matters involving a broad
range of insurance coverages, including commercial general liability,
professional errors & omissions, business interruption, builder’s
risk, homeowners, business and personal umbrella, and property insurance.
McDonald & McCabe has a particular
expertise in property coverage issues. Our attorneys have significant coverage
and litigation experience involving arson and fraud, bad faith, boiler
and machinery coverage, collapse coverage issues, contamination,
valuation disputes, extra expense claims, floods, mold, application of
policy exclusions, and product recall.
McDonald & McCabe’s attorneys also have a particular expertise in
providing coverage opinions and litigating disputes involving commercial
general liability policies. Our attorneys have significant experience
with most aspects of commercial general liability coverage, including
additional insured endorsements, insured contract provisions, other
insurance provisions, the insured’s work and product exclusions,
conflicts of interest arising from the insurer’s reservation of rights,
triggers of the insurer’s defense obligations, and the stacking of
multiple coverage. Our attorneys have also been successful in developing
and implementing creative solutions to coverage disputes in order to
avoid the expense of prolonged litigation.
