Subrogation
The
attorneys of McDonald & McCabe possess a wealth of experience in
subrogation litigation and have been involved in some of the largest,
high profile subrogation cases in the United States and abroad. Our
attorneys have prosecuted such subrogation matters as the Chicago flood
litigation, the First Interstate building fire in Los Angeles, and the largest
property/boiler machinery dispute involving the Quantum Chemical Company,
and the Meridian Bank fire in Philadelphia.
Presently, we are in the process of seeking recoveries for property
losses incurred in the September 11th World Trade
Center attacks and
the 2002 scaffolding collapse at the John Hancock
Building in Chicago.
Our attorneys have significant
engineering and technical experience which allows us to work closely with
our established network of experts in developing theories of recovery
against responsible parties. Our attorneys have extensive experience in
property losses involving fire protection failures, chemical plant
explosions, energy plant construction collapses, electrical power
failures, natural gas explosions, contaminations, over pressurization,
product design and manufacturing errors, professional design errors and
omissions, negligent construction, negligent hiring, mold, and other
areas.
Our attorneys are available to begin
assessing and developing subrogation recoveries immediately upon notice.
We are available 24 hours a day, 7 days a week to respond to major
catastrophes across the country by organizing and directing the
inspecting of a damage site with a team of causation experts. In
addition, through early involvement in a property loss, we are able to
explore and develop witness testimony and preserve documentary and
physical evidence in order to avoid the pitfalls of spoliation. Although
our immediate participation in the investigation of a loss is optimal,
McDonald & McCabe has extensive success in obtaining recoveries for
its clients even when its involvement has not begun for an extended
period after a loss.
McDonald & McCabe has also been
successful in obtaining recoveries for our clients notwithstanding
contractual provisions that appear to prohibit a successful recovery
effort. Our attorneys are experienced in sophisticated contract analysis
and interpretation and have successfully advanced creative legal theories
in the courts to obtain recoveries for their clients. In addition,
McDonald & McCabe provides its clients with an early detailed
evaluation of an incident and the probabilities of successful recovery.
When appropriate, McDonald & McCabe recommends alternative dispute
resolution to avoid the time and expense that may be incurred in
extensive litigation.
We also offer a variety of fee
arrangements to meet the specific needs of our client and the particular
case. Many of our subrogation cases are handled on a contingency fee
basis so that our clients do not pay us any fee until we obtain a
recovery
